1. Acceptance of Terms
By downloading, installing, or using Baby Tracker Lulu ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Baby Tracker Lulu. Please read them carefully.
2. Description of Service
Baby Tracker Lulu is a mobile application that allows parents and caregivers to track baby care activities including feeding, sleep, diaper changes, medications, outings, and developmental milestones. The App offers both free and premium (paid) features.
3. Eligibility
You must be at least 18 years old to create an account and use the App. By creating an account, you represent and warrant that: • You are at least 18 years of age • You have the legal capacity to enter into these Terms • All information you provide is accurate and current • You will use the App only for lawful purposes
4. User Account
4.1 Registration You must register for an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 4.2 Account Security You agree to notify us immediately at info@applulu.com if you become aware of any unauthorized use of your account. 4.3 One Account Per Person You may not create multiple accounts for the purpose of circumventing usage limits or accessing features inappropriately.
5. Subscriptions and Payments
5.1 Free Tier The App offers a free tier with basic functionality. Free tier limitations may change over time. 5.2 Premium Subscription Premium features are available through a paid subscription. Subscription options include Monthly, 6-Month, and Annual plans. Prices are displayed in the App and may vary by region. 5.3 Payment Processing All payments are processed through Apple App Store or Google Play Store, depending on your device. We do not directly handle or store your payment information. 5.4 Auto-Renewal Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. You may manage and cancel subscriptions through your App Store account settings. 5.5 Free Trials If a free trial is offered, you will not be charged until the trial period expires. You may cancel during the trial period without charge. 5.6 Refunds Refund requests are administered by Apple App Store or Google Play Store according to their policies; we do not process payments directly. EU / UK consumers: nothing in this section limits your statutory rights under the EU Consumer Rights Directive (2011/83/EU) or the UK Consumer Rights Act 2015, including the 14-day right of withdrawal for digital services where applicable. If the platform's refund process is unavailable to you, contact info@applulu.com and we will work with you directly.
6. Caregiver Sharing
The App allows you to invite other users as caregivers to share access to baby profiles. By inviting a caregiver: • You represent that you have the authority to share the relevant child's information • You are responsible for the caregivers you invite and their actions within the App • You may revoke caregiver access at any time Caregivers agree to use shared information only for the purpose of caring for the child and to maintain confidentiality of the information. Joint controllers (GDPR Art. 26): when you invite a caregiver, you and the caregiver may both be data controllers for the child's data under GDPR. Each party is responsible for responding to the child's data-subject requests insofar as the request relates to records they entered. Baby Tracker Lulu acts as a processor for both.
7. Acceptable Use
You agree not to: • Use the App for any unlawful purpose or in violation of any regulations • Upload or share content that is harmful, abusive, or violates the rights of others • Attempt to gain unauthorized access to other users' accounts or data • Use the App in any way that could damage, disable, or impair our systems • Reverse engineer, decompile, or disassemble any part of the App • Use the App to collect or harvest personal information about other users
8. User Content
You retain ownership of all content you enter into the App (logs, notes, photos). By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you. You are solely responsible for the accuracy and appropriateness of content you enter. We do not verify medical or developmental information and the App is not a substitute for professional medical advice.
9. Medical Disclaimer
Baby Tracker Lulu is a tracking and organizational tool only. It does not provide medical advice, diagnosis, or treatment. Milestone references and developmental information in the App are general guidelines only and vary widely among individual children. Always consult with a qualified healthcare professional for medical concerns about your child. In case of emergency, contact emergency services immediately.
10. Intellectual Property
All intellectual property rights in the App, including software, design, text, graphics, and logos, are owned by or licensed to Baby Tracker Lulu. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works of any part of the App without our written consent.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE APP IS AT YOUR OWN RISK. Consumer-rights carve-out: nothing in this Section limits statutory rights you may have under mandatory consumer-protection law in your jurisdiction (including, for EU / UK consumers, rights under the EU Consumer Rights Directive, UK Consumer Rights Act 2015, and applicable national laws).
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BABY TRACKER LULU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for death or personal injury caused by negligence, or fraud).
13. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time through Settings → Delete Account. Upon termination, your right to use the App ceases immediately. Sections that by nature should survive termination (including ownership, warranty disclaimers, and limitations of liability) shall survive.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-laws rules. EU / UK / Swiss consumers: this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you habitually reside. You may bring proceedings in the courts of your country of residence. US consumers: disputes shall be resolved exclusively in the state or federal courts located in Delaware, USA, unless mandatory local consumer-protection law requires otherwise.
15. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes through the App. Your continued use of the App after changes constitutes acceptance of the updated Terms.
